Rape
April 30, 2015
All Charges Dismissed 

Charges: Client charged with Rape, a B-Felony, punishable by 8-12 years in prison, which could never be removed from his record if convicted.

Result: Case dismissed. After extensive research, Scott found that the alleged victim in the case had provided false statements to the police and to the court about the events that occurred on the evening of the alleged rape. Scott eventually obtained access to various documents, including phone records and medical records, to find these inconsistencies. After negotiations with the District Attorney, all charges were dismissed the day before trial.


Violation of Probation

Violation Dismissed; Probation Terminated

Charges: Client charged with a second Violation of Probation, punishable by the remainder of a sentence of eight months and twenty-nine days in jail, for a failed drug screen. Client had previously agreed to a first Violation of Probation and served fourteen days at that time.

Result: Case dismissed. After investigation, Scott found that the probation in the case should have terminated long before either the first or the second Violation of Probation. After negotiation with the District Attorney, the Violation of Probation Warrant was dismissed.


Domestic Assault

Charges: Client charged with Domestic Assault, punishable by up to eleven months and twenty-nine days in jail, and which could not be expunged from his record if convicted.

Result: Case retired (state chose not to prosecute the charge for a certain period of time). No jail time and no guilty plea. If certain conditions are met, the case is dismissed.


Felony Aggravated Assault and Vandalism

All Felonies Dismissed; Six Counts Dismissed in Total

Charges: Client indicted on four counts of Felony Aggravated Assault, one count of Felony Vandalism, and two counts of Domestic Assault, facing 3-15 years in jail per Aggravated Assault Charge, 1-6 years in jail for the Vandalism Charge, and up to eleven months and twenty-nine days in jail for each Domestic Assault Charge.

Result: All four Felony Assault charges dismissed without cost. Both Domestic Assault charges dismissed without cost. Client pleaded guilty to only one misdemeanor.


Felony Aggravated Assault

Charges: Client arrested for Felony Aggravated Assault with a Deadly Weapon, punishable by 3-15 years in jail, and indicted with multiple counts of Domestic Assault, each punishable by up to eleven months and twenty-nine days in jail.

Result: All charges retired, which means the State chose not to prosecute the action for a set period of time. No jail time and no guilty plea. If certain conditions are met, the case is dismissed.


Violation of Probation
October 28, 2014
Dismissed

Charges: Client charged with Violating Probation for failing to pay costs and fees and failing a drug screen. If upheld, Client could be sentenced to eleven months and twenty-nine days in jail, less any time he had already served.

Result: Violation Dismissed without costs. No more jail time and no more fees. Client is now off of probation with all charges behind him.


Felony Theft, Aggravated Burglary, and Felony Vandalism

All Charges Dismissed

Case: Client indicted on Felony Theft Over $60,000, punishable by 8-30 years in jail, Aggravated Burglary, punishable by 3-15 years in jail, and Felony Vandalism, punishable by 1-6 years in jail.

Result: District Attorney dismissed all charges outright. No court costs, no jail time, and no fees of any time.
